BroadSoft Law Enforcement Data and Surveillance Requests

In compliance with the BroadSoft Privacy Policy, customer information cannot be released without a valid subpoena, court order, search warrant or other formal demand from an agency authorized to request such information. Data requests for information received from authorized law enforcement authorities will be responded to according to BroadSoft policies, terms, and applicable laws.

BroadSoft, now part of Cisco, is a global communications and VoIP service provider primarily serving business customers. Many of our customers use our VoIP services in a wholesale manner, offering services of their own to their end users. In these cases, BroadSoft does not have a relationship to the end user. As a courtesy, we offer to verify if target telephone numbers are owned by BroadSoft or one of our wholesale partners without formal legal process; this courtesy is offered in order to save members of law enforcement the step of first serving us when in fact such legal process must ultimately be served on our wholesale customer of record in order to obtain any and all end-user information and other records.

Routine/Historical Records Requests

Records requests should be sent via email to datarequest@broadsoft.com. BroadSoft will review and respond to a properly served request for data as required by law and in accordance with its terms of use and privacy notice. Law enforcement should at a minimum include in their request:

  • Clear grounds for the legal basis for the request
  • Detailed specifics on the information sought
  • The name of the issuing authority, badge/ID number of the responsible agent or officer, an email address from a law-enforcement domain, and a direct contact number for the responsible agent or officer.
  • Requested response date

Response times depend on the size and complexity of the request; generally, a response may be expected within thirty (30) days.

Preservation of Records

Preservation requests should be sent via email to datarequest@broadsoft.com. Upon receipt of a formal written request by email, we will work to preserve records in connection with official criminal investigations for 90 days. Law enforcement may extend a preservation request, once, for an additional 90 days. We do not maintain preserved materials unless we receive an extension request or legal process.

Surveillance

Surveillance requests require a valid court order and should be sent via email to datarequest@broadsoft.com. Along with the valid court order, law enforcement should provide the name of the issuing authority, badge/ID number of the responsible agent or officer, an email address from a law-enforcement domain, and a direct contact number for the responsible agent or officer. BroadSoft will assess the request, including, without limitation, any materials delivered, and respond to you accordingly.

Emergency and Exigent Requests

YOU MUST BE A MEMBER OF LAW ENFORCEMENT WITH A DECLARED VERIFIED EXIGENT SITUATION (exigency as established by your own agency’s guidelines). Exigent circumstances requests will be processed upon receipt of a completed Exigent Circumstances Request Form. Following the emergency disclosure, law enforcement agencies must follow-up with a valid subpoena, court order or search warrant formally requesting the disclosed information.
